TERMS & CONDITIONS

These General Terms and Conditions for accommodation reservations (“General Terms and Conditions”), along with the information provided in the booking confirmation email (“Booking Confirmation”), set the terms under which the Company (as defined below) agrees to provide Services through the Website (see definitions below).

These General Terms and Conditions, the Booking Confirmation, and the applicable Rules and Restrictions also set the terms under which Travel Service Providers agree to provide the Services to you.

The Services provided by the Travel Service Providers (as defined below) through this Website can only be used by Customers who have first read these General Terms and Conditions and have unconditionally accepted them by proceeding with the booking process.

Customers undertake to fulfill the obligations contained in these General Terms and Conditions. The agreement between Customers and the respective Travel Service Provider comes into effect once the Company or its Partnering company provides a written confirmation of a booking to the Customer by sending the Booking Confirmation.

Customers should store and/or print a copy of these General Terms and Conditions for future reference when making a booking.

1.2. Scope and Your Relationship with the Company

These General Terms and Conditions apply to the offering and provision of the Services through this Website and include any applicable Rules and Restrictions that are made known to the Customer prior to the completion of any booking, which the Customer also accepts at the time of making the booking. It is the Customer’s responsibility to familiarize themselves with these General Terms and Conditions and the applicable Rules and Restrictions. Specific Rules and Restrictions for accommodation of third-party Providers are provided before making a booking.

The Company may change these General Terms and Conditions and the Providers of travel services may change the Rules and Restrictions at any time without prior notice, although such changes will not apply to bookings that have already been accepted by the Company on behalf of the respective Providers. Therefore, it is necessary for the Customer to read, store, and/or print a copy of the General Terms and Conditions at the time of making the booking in order to be informed about the applicable provisions.

Article 2. Bookings through the Website

2.1. Legal Obligations of the Customer

The Website assists the Customer in finding travel products and making the necessary reservations, while also acting as an interface in the transactions that must be made with the Travel Service Providers.

The customer must be 16 years of age or older, have full legal capacity at the time of making the booking, possess the necessary consent or authorization to act on behalf of and for the account of any individuals included in a booking, and must use the Website in accordance with these General Terms and Conditions.

The customer ensures and hereby confirms that the information provided for all parties of the booking is complete and accurate, that all parties agree to be bound by these General Terms and Conditions, and that the Main Customer has the authority to accept and does accept these General Terms and Conditions on behalf of all customers in the booking.

The customer is the person responsible for the booking, the payment of the deposit and the full price, submitting any requests for modifications and cancellations, paying any additional charges related to the booking, and for all other matters concerning the booking.

The customer agrees to review all descriptions contained in the travel documents received after making the booking and to inform us immediately of any errors or other incidents, including cases where the personal details do not match those listed on the passports of the individuals traveling based on the booking.

The customer is responsible for their actions on the Website (financial or otherwise), including the potential use of their username and password. The customer guarantees that the details entered by them on the Website regarding themselves and, depending on the case, their fellow travelers are accurate.

Any use of the Website that is fraudulent or violates these General Terms and Conditions constitutes a cause for denying Customers access to the Services provided by the Company and third-party Providers or to other functions of the Website.

2.2 Confirmation, Change, and Cancellation of Reservations (subject to Articles 3.1, 3.2, 4.2, and 5.2, as applicable)

2.2.1 Confirmation

The Booking Confirmation, which includes essential details such as the description of the Services booked and the price, will be sent to the Customer via email. If the Customer does not instantly receive a Confirmation upon making the reservation, they should contact Customer Service at support@thebookingexpert.com .

It is expressly agreed that the data stored in the Company’s or Third-party Providers’ information systems constitutes proof of the reservations made by the Customer. Data stored on computers or electronic media are valid evidence and are, therefore, acceptable under the same terms and have equivalent evidentiary value as a printed document.

2.2.2 Cancellation

For service bookings, cancellations can only be made by contacting us at support@thebookingexpert.com  or by phone at +30 211 211 8702 – 03.

Each such request will be processed on behalf of the respective Travel Service Providers. Customers do not inherently have the right to cancel unless this right is provided by the respective Third-party Provider, based on the Rules and Restrictions (which are communicated to the Customer before booking).

In the event of cancellation or partial cancellation of a booking, charges may be imposed by the respective Third-party Providers—refer to the Rules and Restrictions notified during the booking process for more details. If a cancellation affects more than one person in the booking, any applicable cancellation charge will apply to each individual in the booking.

We reserve the right to completely cancel a customer’s booking if full payment for the booking or any applicable cancellation fees related to a booking are not received in a timely manner.

In cases where the company or the Third-party Supplier has reason to believe that fraud has been committed, it is not obliged to process a change, cancellation, or refund requested by the Customer.

2.2.3 Change of Booking

If after making the booking, the Customer wishes to change the service booking, they must call +30 211 211 8702 – 03. A fee may be charged by the respective Third-party Provider in case of a booking change—refer to the Rules and Restrictions notified during the booking process for more details.

The Company (and the respective Third-party Provider) reserves the right to completely cancel a customer’s booking if full payment for any applicable change fee related to a booking is not received in a timely manner.

2.2.4 Refunds

A refund shall be made to the original instrument used at the time of booking. In the event the Company is unable to immediately refund the amount, such amount shall lie as future available credit for the customer.
Refunds will be done only through the Original Mode of Payment.

2.2.5 Limited Prices

Unless the Customer states otherwise, it is assumed that they desire the least expensive travel Services. These Services (e.g., “non-refundable” prices) may be provided without the possibility of modification or cancellation. In these cases, the Services cannot be provided in a different manner or at a different time or place than originally agreed.

2.3 Travel Documents

The travel documents provided for a Service that has been ordered through the Website will be sent to the email address provided by the Main Customer at the time of their booking.

Article 3: Accommodation Services

The Company manages the Website, which operates as an interface between the Customer and the Travel Service Provider regarding the offering and provision of all Services.

The purpose of this Article 3 is to provide details about the terms and conditions of using the Services offered by the Travel Service Provider to inform the Customer. These details are not exhaustive and do not replace the existing Rules and Restrictions. In the event of any dispute or discrepancy between the General Terms and Conditions and the Rules and Restrictions incorporated into these General Terms and Conditions, the Rules and Restrictions shall prevail. The Rules and Restrictions are communicated before making a booking.

Subject to any contrary regulatory requirements, these specific details do not establish any liability or obligation on the part of the Company.

Subject to Articles 3.6 and 5.2, any prepaid accommodation bookings through the “pay now” option require charging the Customer’s credit card with the full payment amount at the time of booking. Refer to the details displayed during the booking process to confirm how and when payment will be made. Prices shown on the Website do not include fees or charges for optional additional services, such as snacks from the mini-bar or telephone calls.

If a customer does not show up for the first night of the booking and intends to check in for subsequent nights, the Customer must confirm the changes to the booking to the Company by no later than 24 hours prior check-in date to avoid cancellation of the entire booking. If the Customer does not confirm the booking changes to the Company, the entire booking may be canceled, and a refund to the Customer will only be made according to the applicable Rules and Restrictions, as notified during the booking process.

If a customer does not cancel or change their booking before the cancellation policy period applicable to the accommodation (which varies depending on the accommodation and is noted during the booking process), they will be charged according to the booking’s Rules and Restrictions. Customers should note that some accommodations do not allow changes or cancellations after they are made, and these specific restrictions appear in the Rules and Restrictions for the accommodation booking.

You cannot book online for more than 9 guests at the same hotel for the same stay dates. If we find that you have booked for more than 9 guests in total, across separate bookings, we may cancel the bookings and charge you a cancellation fee, as applicable. If you paid a non-refundable deposit, you might lose your deposit. If you wish to book for 9 or more guests, you must contact us at support@thebookingexpert.com  or by phone at +30 211 211 8702 – 03. You may be asked to sign a written contract and/or pay a non-refundable deposit.

3.1. Room Use

Customers are reminded that, in general, rooms are available only from 3:00 PM and must be vacated by 11:00 AM, regardless of the time of arrival or departure or the means of transport used. Exact check-in and check-out times are available in your booking confirmation.

Double rooms typically have two single beds or one double bed. Bed configuration is always subject to the hotel’s availability.

3.2. Rating

The level of comfort indicated in the hotel descriptions on the Website corresponds to a classification based on local criteria in the specific country, which may differ from criteria in your country. This classification is provided for guidance only. Customers should be aware that criteria may vary between hotels of the same category in different countries, even within the same country. It is important to carefully read the individual hotel descriptions. All hotel accommodation, regardless of rating, typically provide standard rooms unless stated otherwise.

1 star: These have the lowest prices. The accommodation meets minimum facility requirements and is generally clean and simple. Bathroom facilities are usually shared.

2 stars: Simple accommodation with a bit more attention to style and ambiance, but also at a low price. Facilities and service are limited. May include a number of public areas, a shop, or, for example, a cafe.

3 stars: For travelers who want something extra and value service, quality, style, and comfort. Also recommended for families. Usually, there is a restaurant serving at least breakfast and sometimes lunch and/or dinner. Conference rooms and sometimes other facilities like a swimming pool, or services for business travelers, may be available.

4 stars: First-class accommodation for the more demanding customers. Attention has been paid to luxury, hospitality, and service. In these reliable hotels, expect to find a high-quality restaurant and a range of amenities. First-class accommodation for business travelers.

5 stars: Top-class accommodation that meets the highest possible requirements. These hotels offer impeccable personal service, tasteful and elegant facilities, and every possible comfort. Among the best

From time to time and for various reasons (for example, when a property is overbooked due to connectivity issues or a booking may be canceled or modified by the Third-party Provider of the accommodation or by the Company. Should this occur, the Company will make every reasonable effort to notify the Customer as soon as possible and, where feasible, will offer alternative accommodation, at least of the same star category with similar services. If this offer is not accepted by the Customer, the Company will ensure the return of the total amount paid for the booking. In specific cases, for instance, when a technical issue from the Company has caused the cancellation or modification of a booking and such cancellation or modification causes direct damage to the Customer, the Company will also provide reasonable compensation.

3.3 Activities

Occasionally, specific activities provided by Third-party Providers and listed in the accommodation description on the Website may be canceled, for example, due to weather conditions or other causes beyond the control of the Third-party Provider, during off-season stays, or if the required number of participants for the activity is not met.

3.4 Meals

If meals are included in an accommodation package, the number of meals depends on the number of nights stayed. Full board usually includes breakfast, lunch, and dinner. Half-board typically includes breakfast and either lunch or dinner, depending on the accommodation package. In accommodations that include main meals, usually, the first meal is dinner on the day of arrival at the property and the last meal is breakfast (for half-board) or lunch (for full board) on the day of departure. If it is not possible to consume one or more meals, no refund is made.

Customers are reminded that, unless otherwise stated on the Website, drinks are not included with meals. If drinkable water is not available, the Customer will bear the cost of purchasing it.

Parents are advised to bring special food for their baby, as it may not always be available in every area.

3.5 Taxes

Local authorities in some countries may impose additional taxes (tourist tax, etc.) which generally must be paid locally. The Customer is solely responsible for paying these additional taxes. The amount of the taxes may change between the booking and stay dates. If taxes have increased by the date of stay, you will need to pay the new higher amount of taxes.

Article 4: General

4.1. Travel Destinations

Although most travel, even to international destinations, is completed without incident, traveling to certain destinations may involve greater risks than others. The Company advises Customers to review any travel restrictions, warnings, announcements, and advisories issued by the travel advisory authority of their country regarding international travel that are available on its website.

By offering travel to particular international destinations, the Company does not represent or warrant that travel to such points is advisable or without risk, and is not liable for damages or losses that may result from travel to such destinations.

Health: Recommended vaccinations for travel may change, and you should consult your doctor for current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, take recommended vaccinations, carry all necessary medications, and follow all medical advice in relation to your trip. For medical advice regarding your trip, contact your doctor.

4.2. Pricing

The price of the Services is as stated on the Website from time to time, except in cases of obvious error. Prices are subject to change at any time, but changes will not affect bookings already accepted. The Company may, in some cases, impose a booking fee in relation to certain transactions made on behalf of the Customer. The Customer will be notified of all applicable charges at the time of booking. Despite the Company’s best efforts, some of the Services listed on the Website may be incorrectly priced. THE COMPANY EXPRESSLY RESERVES THE RIGHT TO CORRECT ANY PRICING ERRORS ON THE WEBSITE AND/OR ON PENDING RESERVATIONS MADE UNDER AN INCORRECT PRICE. In this case, if feasible, we will offer you the opportunity to keep your pending reservation at the correct price or, at your option, we will cancel your reservation without penalty. The Company is under no obligation to provide the Services to you at the incorrect (lower) price, even after you have been sent confirmation of your booking.

4.3. Method of Sorting Listings

Customers have several options that can help them find the ideal accommodation. The “sorting” settings allow travelers to prioritize search results according to their preferences, whether based on price, ratings of verified reviews, or other criteria. The “filter” settings also allow Customers to include or exclude various options to meet their travel needs. If no choices are made, we will display a range of relevant options in the search results, based on the criteria described below.

The default order of sorting reflects the relevance of accommodation to your search criteria, as we want to ensure that you can quickly and easily find the deal that’s right for you. We calculate relevance by considering factors such as the location of a property, its review scores, the quality of content provided by the property, and the competitiveness of prices and availability of the property, all in relation to other properties that meet the search criteria you have selected.

4.4. Photos and Images

The Company strives to provide photos and images that give the Customer a depiction of the Services offered by the provider or the properties, which represent the level of accommodation and comfort offered, and should not be anything more than that.

There may be links to third party websites on our web site www.b2b.thebookingexpert.com  which are only for information. Such sites are independent of The Booking Expert and are not responsible for it or the material contained within.

Article 5. Financial Terms and Payment Procedures

5.1 Local Taxes and Payments

Unless otherwise specified in the Rules and Restrictions, the prices of the Services displayed on the Website are expressed in the selected currency and do not include local taxes imposed by the authorities in some countries.

The execution of any prepaid accommodation bookings with the “pay now” option for destinations within the European Union is governed by the regulations for travel agencies and tour operators, as referred to in Articles 306-310 of the EU VAT Directive [2006/112/EC].

5.2 Tax Recovery Fee

Apart from what is provided below regarding tax obligations for the amounts we withhold for our services, we do not collect taxes for payment to the competent tax authorities. The tax recovery fees on prepaid accommodation bookings with the “pay now” option represent a recovery of the estimated transaction taxes (e.g., sales and use, lodging, room tax, indirect tax, value-added tax, etc.) that the Company pays to the accommodation for taxes imposed on the room rental for those transactions in which the Company provides the Service directly to the Customer. The accommodation invoices the Company for the tax amounts. The accommodation is responsible for paying the applicable taxes to the competent tax authorities. The Company does not act as a joint supplier with the accommodation to which our customers make bookings or arrange to travel. Tax imposition and tax rates vary significantly by location. The actual tax amounts paid by the Company to the accommodation may differ from the tax recovery fee amounts, depending on the rates, taxation, etc., that apply at the time of the actual use of the accommodation by our customers. Beyond the above, sales, use, and/or local lodging taxes may be imposed on the amounts charged by the Company for its services in some jurisdictions. The actual tax amounts on our services, if any, may vary depending on the rates that apply during your stay at the accommodation.

5.3 Payments

Method of Payment, Card Types accepted and Currency
We accept payments online using Visa and MasterCard credit/debit card in EUR.

Besides any other taxes and fees that must be paid by the Customer as defined in these General Terms and Conditions, the taxes and fees may vary depending on the payment option the Customer makes. Note that some properties may require a deposit which may or may not be refundable (refer to the applicable Rules and Restrictions). Tax rates and exchange rates may change between booking and stay dates. Your credit card provider may also charge a foreign currency conversion fee.

Some banks and credit card companies impose fees for international or cross-border transactions. Furthermore, some banks and card companies impose also currency conversion fees. For example, if you make a booking in a currency different from that of your credit card, your credit card company may convert the booking amount to the currency of your credit card and charge you a conversion fee. The exchange rate and foreign transaction fees are determined solely by your bank on the day the transaction is processed. If you have questions about these fees or the exchange rate applicable to your booking, contact your bank.

5.4 HOW DO WE PROTECT YOUR PAYMENT INFORMATION

If you select payment method “Pay by CC” from our website with a debit or credit card, you are always transferred to a secure bank environment for your purchase. We never collect your bank card information, nor will we ever ask for information such as your card number, CCV, or PIN while you are on our website.

Bank card information is not stored or processed on our servers. All credit/debit cards details and personally identifiable information which will NOT be stored, sold, shared, rented, or leased to any third parties”.

Article 6. Customer Service and Complaint Handling

Queries or requests for information or complaints during a trip should be sent to the address support@thebookingexpert.com . Alternatively, the Customer may call the Company’s customer service department at the number provided on the Help page.

The Booking Expert in relation to the above and any other claims will only attend complaints that have been previously reported during the stay of the guests in the hotel (by either the Customer or the final consumer).

Any written complaints should be addressed either to the third-party Provider who provided the Service, using the address mentioned in their Rules and Restrictions, or to the Company.

Complaints about lost, stolen, or damaged luggage, clothing, or personal items not under the Customer’s control during the stay should be addressed to the airline, hotel, or relevant third-party Provider.

Please note that failing to report problems during the holiday, as described above, deprives us and the third-party Provider of the opportunity to investigate and rectify your complaint issue while you are at the resort and this may affect your rights under this contract including reducing any compensation due, which may become zero.

The European Commission’s online dispute resolution platform is available at http://ec.europa.eu/odr

Article 7. Company Liability

The Customer acknowledges that in cases where the Company acts as an interface between the Customer and the travel service Providers, the Company shall not be considered liable under any circumstances regarding the Services for which the Customer has made reservations with one or more travel service Providers. The Company bears no responsibility if the Customer can raise claims for damages under an insurance policy, such as travel insurance and/or holiday cancellation insurance.

The company does not accept any liability for any claims, losses, expenses, damages, or obligations, except in cases where death, injury, or illness has occurred for which the company has caused the damage due to negligence.

The information displayed on this Website has been provided by the respective third-party Providers and the Company does not accept any liability for any inaccuracies. Customers should ensure to verify all provided information before making a reservation.

Customers should note that all displayed hotel ratings are purely indicative and may not constitute an official evaluation or correspond to the local classification. The Company accepts no responsibility for the ratings presented.

If the Company and/or the third-party Provider detect or are informed of any fraud or illegal activity associated with the payment for the booking, the booking will be canceled and the Customer will be responsible for all costs arising from such cancellation, subject to any action that may be brought against them.
